Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Flayre mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. Flayre reserves the right to update these Terms at any time, and your continued use of the App after any changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old to create an account and use Flayre. Because Flayre is designed for nightlife venue discovery, many featured venues serve alcohol and require patrons to be 21 or older. You are solely responsible for complying with all applicable age requirements and local laws when visiting any venue displayed in the App. Flayre does not verify your age at venues and is not responsible for ensuring compliance with minimum drinking age laws.

3. Account Registration and Security

To use Flayre, you must create an account using a valid email address. We use passwordless authentication via email magic links. You are responsible for maintaining the security of the email account associated with your Flayre account. You agree to notify us immediately of any unauthorized access to or use of your account. Flayre is not liable for any loss or damage arising from unauthorized use of your account.

4. User Conduct

You agree not to use Flayre to:

  • Harass, threaten, intimidate, stalk, or bully other users
  • Send unsolicited, abusive, or hateful messages through any in-app communication feature
  • Engage in or promote hate speech, discrimination, or violence based on race, ethnicity, gender, sexual orientation, religion, disability, or any other protected characteristic
  • Impersonate another person or entity
  • Engage in or promote illegal activity, including underage drinking
  • Use the App for commercial solicitation, spam, or advertising without prior written consent
  • Attempt to reverse-engineer, decompile, or tamper with the App or its systems
  • Interfere with the operation of the App or circumvent security measures
  • Create multiple accounts for deceptive or abusive purposes

Flayre reserves the right to investigate and take appropriate action, including suspending or terminating your account, for any violation of these guidelines.

5. Content Guidelines

When uploading profile photos or other content to Flayre, you agree that:

  • All photos must be of you and accurately represent your appearance
  • No explicit, sexually suggestive, or NSFW content is permitted
  • No photos depicting illegal activity, violence, or drug use
  • No copyrighted material you do not have the right to use
  • No photos of minors (under 18)

Flayre may remove any content that violates these guidelines without notice.

6. Spark and Flame Features

Flayre's Spark and Flame social matching features are designed to facilitate consent-based connections between users at the same venue. A "Spark" is a one-way expression of interest. A "Flame" is only created when both users send each other a Spark (mutual interest). You understand and agree that:

  • Flayre does not guarantee any connection, match, or interaction with other users
  • All interactions must be consensual and respectful
  • Flame Finder (UWB proximity) is an optional feature to help matched users find each other in person. You can disable this at any time.
  • Flame messages are ephemeral and may be deleted when a Flame ends
  • Flayre is not responsible for the conduct of other users in person
  • You may block or report any user at any time

7. Location Data and Geofencing

Flayre uses your device's location services to provide venue discovery, real-time crowd levels, and automatic check-in functionality via geofencing. By using the App, you consent to the collection and use of your location data as described in our Privacy Policy. You may revoke location permissions at any time through your device settings, but this may limit the functionality of the App. Geofencing allows automatic venue check-ins when you enter or exit a participating venue's area. This data is used to provide anonymous, aggregate crowd-level information to all users.

8. Push Notifications

Flayre may send push notifications for busyness alerts, Sparks and Flames, and other relevant updates. You may opt out of push notifications at any time through your device settings. Opting out may cause you to miss time-sensitive alerts such as incoming Sparks or Flame messages.

9. Premium Subscription

Flayre may offer a premium subscription tier with additional features. If you subscribe:

  • Payment is processed through the Apple App Store
  • Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period
  • You can manage and cancel your subscription through your Apple ID settings
  • No refunds are provided for partial billing periods upon cancellation
  • Flayre reserves the right to change subscription pricing with reasonable notice
  • Free trial periods, if offered, automatically convert to a paid subscription unless cancelled before the trial ends

10. Gamification and XP

Flayre includes gamification features such as experience points (XP), badges, leaderboards, and streaks. These are for entertainment purposes only and have no monetary value. Flayre reserves the right to modify, reset, or remove gamification features at any time.

11. Intellectual Property

The Flayre name, logo, design, and all associated content, features, and functionality are owned by Flayre and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without prior written consent. By uploading content to Flayre, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content within the App for the purpose of providing the service.

12. Disclaimer of Warranties

Flayre is provided "as is" and "as available" without warranties of any kind, either express or implied. Crowd-level and busyness data displayed in the App is approximate and based on a combination of third-party forecast data and anonymized device signals. We do not guarantee the accuracy, completeness, or timeliness of this data. Venue information including hours, events, and deals may not always be current. Flayre does not warrant that the App will be uninterrupted, error-free, or secure.

13. Limitation of Liability

To the maximum extent permitted by law, Flayre and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses arising from: (a) your use or inability to use the App; (b) any interactions with other users, whether online or in person; (c) inaccurate busyness or venue data; (d) unauthorized access to your account; or (e) any other matter relating to the App. In no event shall our total liability exceed the amount you have paid to Flayre in the twelve months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Flayre and its operators from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from your use of the App, violation of these Terms, or infringement of any rights of a third party.

15. Termination

Flayre may suspend or terminate your account at any time, with or without cause and with or without notice, including for violation of these Terms or conduct that we deem harmful, abusive, or otherwise inappropriate. You may delete your account at any time through the in-app settings. Upon termination, your right to use the App ceases immediately. Account deletion will remove your profile data, photos, and associated information as described in our Privacy Policy.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising from these Terms or the use of the App shall be resolved in the courts located in Cook County, Illinois.

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App or via email. Your continued use of the App after the revised Terms become effective constitutes your acceptance of the changes. We encourage you to review these Terms periodically.
